ESTATE PLANNING & PROBATE

Probate is the process of administering an estate through the court. All wills are prepared with Probate in mind. They are the directions to the court as to how the estate will be distributed to the heirs. Probate includes filing a petition with court, appointing the executor/administrator, filing reports of all assets and debts, making sure all bills are paid, filing tax returns and distributing the assets.
The probate process will take anywhere from 8 months with an easy to administer will to 18 months or more for a difficult to administer estate. The executor/administrator will hire an attorney to file the reports with the court and run the case through the court system, but the executor does all the work to account for the estate, pay the bills and liquidate the assets for distribution.
